Understandings when commissioning a model.

Understandings related to my work, my methods and my tolerances.

• The model will be made in my own style, unless specified during the process of accepting the commission or early on in the commission progress. You can check my gallery to see the examples of what I have made in the past. My style is also subject to changing over time as I develop my skills.
• For VTubers, VRChat characters, and Game characters, please ensure that you have rights to use the model. I am not accountable for any copyright issues if you do not own the rights to the character.
• Please understand that while I am willing to try to do all types of designs, I will charge extra for complex designs that do not align with my preffered subjects. Intricate patterns and overly detailed characters will incur additional costs.
• I will do NSFW content for a slightly higher cost, but please specify it as such. Explicit NSFW content will not be posted on any account, however SFW content will be included in my turnaround.
• Content that is not explicitly NSFW but still contains material that can be considered sexual or suggestive in nature will have a higher cost, and I will not associate with it (as mentioned previously). Please keep in mind that a character who is nude but has no genitalia (akin to a barbie doll) is not counted as sexual, unless the porportions are exagerated.
• I will refuse commissions relating to hate groups, government bodies or certain topics. This includes political/historical figures and members of modern historical factions, and non-fictional military personel.
• Commissions for NFT collections, or other such projects, will be denied.
• I am strictly against using AI for profit or to take work from artists and other creatives and I will never use it in my models.

My Rights as an Artist / Modeller.

These are rights I have when dealing with commissions as an independent creator.

• I have the right to decline a commission if I disagree with the content.
• I have the right to decline services if you act questionably.
• If other commissions are in progress at the time of discussion I have the right to finish them before working on yours.
• Depending on the size of a commission I have the right to take another commission and finish it before finishing yours (Please keep in mind this will only typically be done if the commission in question is small and can be completed quickly).

Refunds and Cancellations

This section is related to the refunding of projects due to a change of heart or issues with the commission.

• Refunds due to a change of heart can only be claimed towards the beggining of the process. After I have shown the first WIPs of the character and it is approved with no further changes needed, full refunds due to a change of heart will be declined. Partial refunds depending on the amount completed will be accepted. Amount refunded is up to my discression
• If you act in a way that causes me to cease working on your commission, you will be refunded based on the amount that was completed, at my own discression. A commission cancelled due to a lack of feedback / responses will be refunded based on the amount completed, but a commission cancelled due to rude/uncooperative behaviour will be refunded at my own discression.
• Partial refunds due to a financial emergency are possible, but a full refund can be declined based on the amount of work completed. Please make sure to prioritise your own needs before purchasing art.

Modifications and Revisions

These relate to requests to modify my work after the commission has been completed.

• Issues with a model that cause major problems such as incompatibilities or broken geometry can be modified as many times as required until fixed. Models done on vgen will have a higher priority if they have yet to be finalized, I will fix issues on models without an additional cost, but I will not prioritize it if I have more pressing matters.
• Additions to the model will be decided on a per-addition basis - in most cases, I am willing to do free additions, within reason. Expressions are much more likely to be free as they don't take much work.

Copyright and Intellectual Property

This relates to the copyright of finished works and the intellectual property of the characters featured. This section also contains stances regarding monetisation of my work.

• You have the right to profit off of works using the completed models, but can not directly resell the models on a marketplace unless paying extra for a license to the model's copyright.
• Adjustments can be made to the model, however making minor adjustments as a way to excuse the reselling of the model, as per the previous point, will not be tollerated.
• Assuming the character belongs to you / you have right to profit off of the character, you have the right to use VTuber models commercially but not to resell them.
• Intellectual property of characters will belong to the commissioner or owner of the intellectual property. Please ensure you either own the intellectual property or have permission to commission models of that IP.
• Copyright of the models will belong to myself, and theft or passing off the model as your own work will not be tollerated.
• You have full permission to upload commissioned artwork or screenshots of the model to social media or other public sources, assuming you have permission from the IP holder. Credit to me / sharing my posts of your model is appreciated but not required.

Payment and Currency

Information on accepted currencies and payment platforms.

• The commission must be payed for work to commence.
• Payment invoices will be created via paypal, but can be paid for without a paypal account.
• Tips can be accepted, and while not required are greatly, greatly appreciated.
• If the model is used for a larger project, a 'percentage of profits' is not a viable form of payment. A discount can be applied to the cost of the commission if I can verify the project is legitimate and well managed, with a percentage of profits covering for the remainder. For example a 50.00£ commission could be lowered to £35.00 + a percentage of profits, depending on how much I'm willing to put in for the project. If you haven't worked on previous projects in any capacity, you will be denied service.

Failure to abide by conditions mentioned in this terms of service when commissioning can result in being blacklisted, and being rejected from further commissions. Please make sure when commissioning, if you are unsure, you have read / understood these terms. Generally, I am very flexible and often will work within my own capacities, however when commissioning assume the terms in this page are the case.
